TERMS OF SERVICE

1. General

By placing an order or using a shop managed by Every Night Studios ("ENS", "we", "us"), you agree to the following terms. Please read them carefully before purchasing or engaging our services. Every Night Studios is a print studio based in Stockholm, Sweden (Frihamnsgatan 12, 115 56 Stockholm).

2. Products & Orders

All orders are subject to availability and confirmation. We reserve the right to refuse or cancel any order at our discretion. Product colours and finishes may vary slightly from what is shown on screen due to the nature of print production.

3. On-Demand Shops

Every Night Studios designs, manages, and operates print-on-demand shops on behalf of third-party clients ("Shop Owners"). This includes the visual design, product setup, and ongoing management of each shop. When purchasing from one of these shops, you are buying a product fulfilled by Every Night Studios on behalf of the Shop Owner.

ENS is responsible for shop design, production, and fulfilment. The Shop Owner is responsible for approving the shop's branding, product selection, and pricing prior to launch. Any changes to shop design or setup after launch may be subject to additional fees.

Every Night Studios reserves the right to suspend or close a managed shop in the event of non-payment, misuse, or violation of these terms by the Shop Owner.

4. Custom & Personalised Products

Orders involving custom printing or embroidery are produced specifically for you and cannot be returned or exchanged unless defective or incorrectly produced. Please review all artwork, text, and specifications carefully before confirming your order.

5. Pricing & Payment

All prices are listed in the currency displayed at checkout and exclude VAT unless otherwise stated. For managed shops, base pricing is determined by ENS and retail pricing is agreed upon with the Shop Owner prior to launch. We reserve the right to adjust base pricing at any time with reasonable notice to Shop Owners. Payment is required in full before production begins.

6. Production & Delivery

Production times vary depending on order type and volume. Estimated timelines will be provided at the time of order. Every Night Studios is not liable for delays caused by third-party shipping carriers or circumstances beyond our control.

7. Returns & Refunds

Returns and refunds are handled in accordance with our Refund Policy. Custom and on-demand products are non-returnable unless faulty. For all return enquiries, contact hello@everynightstudios.com.

8. Intellectual Property

All shop designs, layouts, and visual assets created by Every Night Studios remain the intellectual property of ENS unless otherwise agreed in writing. Shop Owners retain ownership of their own brand assets and submitted designs.

By submitting or approving artwork and designs for use in an ENS-managed shop, the Shop Owner confirms they hold the rights to all material and grants Every Night Studios permission to reproduce it solely for production and shop display purposes. ENS is not liable for intellectual property infringements caused by material submitted or approved by Shop Owners.

9. Shop Owner Responsibilities

Shop Owners are responsible for reviewing and approving all shop design, product listings, pricing, and content before launch. Once approved, ENS proceeds in good faith on the basis of that approval. ENS acts as a production, fulfilment, and design partner and is not liable for claims arising from the Shop Owner's marketing, representations, or customer relationships beyond what ENS has designed and managed.

10. Liability

Every Night Studios is not liable for indirect or consequential losses arising from the use of our products, services, or managed shops. Our total liability shall not exceed the value of the order or service agreement in question.

11. Privacy

We collect and process personal data in accordance with applicable Swedish and EU data protection law (GDPR). Your data is used solely for order fulfilment and communication purposes and will never be sold to third parties. Shop Owners are independently responsible for their own GDPR compliance in relation to their customers.

12. Governing Law

These terms are governed by Swedish law. Any disputes shall be subject to the jurisdiction of Swedish courts.
